The Austin 3rd court of appeals struck down the University of Texas’ motion to throw out a lawsuit filed by former Longhorns track and field coach Bev Kearney, according to the Austin-American Statesman.
Kearney filed the $1 million lawsuit against the University in November 2013 after she resigned from the athletics department. She left her position in January of that year after being informed that her contract would be terminated for having an inappropriate relationship with a student athlete in 2002.
Kearney is alleging that the University treated her unfairly with the dismissal. She believes she was punished differently than other University employees who had relationships with students.
Texas must now appeal to the Texas Supreme Court if it hopes the lawsuit be tossed out.
Kearney led Texas to six national titles during her tenure from 1993-2013.
